Romania has implemented the Quotation for criticism or review (Art. 5.3(d) InfoSoc) exception in Article 35, para 1, (b) of the Law No 8/1996 on copyright and related rights. The national exception is slightly more restrictive than the EU exception.

This exception allows for short quotations from a work previously made public for the purpose of analysis, commentary or criticism or as an example, insofar as their use justifies the length of the quotation.

  • use must not contravene the normal exploitation of the work and not harm the author

Remarks: According to art. 120, the provisions regarding the limits of copyright also apply accordingly to related rights. Under art. 134 they apply by analogy to broadcasting organizations.
