Luxembourg has implemented the Use of works of architecture or sculptures in public spaces (Art. 5.3(h) InfoSoc) exception in Article 10, 7° de la Loi du 18 avril 2001 sur les droits d’auteur, les droits voisins et les bases de données. The national exception closely resembles the EU exception.

Remarks: This national exception is also associated with the incidental inclusion exception under art. 5(3)(i) of the InfoSoc Directive, because of the requirement for the works used to not be the main subject of reproduction or communication.

The scope of the exception is not extended to neighbouring rights under Art. 46 (1) or Art. 55 - for broadcasters. All exceptions apply mutatis mutandis to the distribution right.
